“On a moratorium on the application of certain provisions of the land legislation”
6 May 2016 President of Kazakhstan Nursultan Nazarbayev signed a decree “On a moratorium on the application of certain provisions of the land legislation”
The decree states:
In accordance with Article 40, paragraph 3) of Article 44 of the Constitution of the Republic of Kazakhstan decrees:
Enter up to 31 December 2016 on a moratorium:
1) the application of the Law of the Republic of Kazakhstan dated November 2, 2015 “On amendments and additions to the Land Code of the Republic of Kazakhstan”;
2) the provision of foreigners, stateless persons, foreign legal entities, as well as legal persons in the authorized capital of which the share of foreigners, stateless persons, foreign legal entities is more than fifty percent, temporary land use rights under the lease of agricultural land;
3) the provision of private ownership of agricultural land, owned by the state, individuals and legal entities.
The Government of the Republic of Kazakhstan:
1) Ensure that legislative amendments aimed at the implementation of paragraph 1 of this Decree;
2) form the Commission on Land Reform;
3) take other measures for the implementation of this Decree.
General Prosecutor’s Office of the Republic of Kazakhstan to provide oversight of the legality in the implementation of paragraph 1 of this Decree.
Control over the execution of this Decree to assign to Presidential Administration of the Republic of Kazakhstan.
This Decree comes into force from the date of signing.
