Majilis approved the bill on ratification of the Agreement on the procedure for investigating accidents at work

Today at the plenary session of the Majilis of the Parliament of the Republic of Kazakhstan approved the draft Law “On ratification of the Agreement on the procedure for the investigation of industrial accidents that have occurred with the citizens of one Member State of the Eurasian Economic Community in the implementation of labor activity in the territory of the other EurAsEC member states” ( further – the Agreement).

The agreement is aimed at mutual protection of labor rights of citizens of the Republic of Kazakhstan, the Russian Federation, Belarus, Kyrgyzstan and Tajikistan, who suffered from accidents at work.

The ratification of the document presupposes the consolidation of the procedure for investigating accidents at work with citizens, including those who are self-employed and also employed by the enterprises of these countries.

As pointed out in her speech, the Minister of Labor and Social Protection of Population of the Republic of Kazakhstan Madina Abylkasymova, under the rules of the agreement, the procedure for the investigation of accidents in the workplace, determined in accordance with the laws of the state of employment.

At the same time, the agreement provides for a single countries – participants of the act of a form of industrial accident number N-1E, which at the end of the investigation the employer must give the employee, with a copy of the report sent to the State Labor Inspectorate state of employment.

Documents issued in connection with the investigation of an accident or their certified copies issued in the territory of one of the participating countries are accepted by other countries parties to the Agreement without legalization.

Thus, for the affected citizens, the process of further compensation for harm to health and obtaining compensation payments related to accidents at work is greatly simplified.

Compensation for damage to the health of the employee, is made in accordance with the legislation of the State of employment.

The agreement does not contradict the Constitution of the Republic of Kazakhstan, labor legislation, in particular the Labor Code of the Republic of Kazakhstan and the adoption of international treaties and does not require additional financial costs to the state budget.
