CC. There are no any barriers for pre-term presidential elections


The Constitutional Council clarified, that the norm of paragraph 3-1 article 4КС эмблема, 25.02.151 of the Constitution of the Republic should be understood in the way that the President of the Republic of Kazakhstan has the exclusive right to assign individually the pre-term presidential elections. The Constitution does not foresee any conditions and  abridgements while taking a decision by the Leader of  the state of  assigning pre-term elections. While taking a decision of pre-term elections the position that the President’s and Parliament’s new  members elections concurrency is inadmissible, set in paragraph 3 article 41 of the Constitution  of the Republic of Kazakhstan,  should be taken into consideration.
